This petition is filed by the respondent challenging the order dated 23.08.2024 in Criminal Misc.No.235/2021 on the file of the Principal Judge, Family Court, Dharwad. 3. It is the case of the claimant/petitioner before the Family Court that the respondent herein is the legally wedded wife of the petitioner herein and their marriage was solemnized on 16.06.1978. It is further stated in the petition that, the respondent herein has filed Crl.Misc.No.60/2008 before the Senior Civil Judge and JMFC, Ranebennur and said petition came to be compromised. It is also to be noted from paragraph 9 of the impugned order that the matrimonial proceedings have been filed by each other including the dispute of dissolution of their marriage. 4. Taking into consideration that the marriage is not disputed and the petitioner herein is a retired Ex-serviceman - 3 - NC: 2025:KHC-D:54 RPFC No. 100165 of 2024 and therefore, granting of maintenance @ ₹8,000/- per month by the Family Court is just and proper, which does not call for any interference in this petition taking into consideration that the respondent herein is residing separately from the petitioner at Dharwad.
