The present application u/s 528 BNSS has been filed with prayer to quash the orders dated 31.5.2024 and 13.5.2025, passed by Additional Chief Judicial Magistrate, Kanpur Nagar, in Complaint Case No. 8 of 2024 (Smt. Pinki v. Shivram and Others), under Sections 323, 504, 506, 498A of IPC, Police Station Kohna, District Kanpur Nagar, whereby learned Magistrate issued bailable warrant of Rs. 10,000/- against the appellant. Learned counsel for the applicant submitted that the applicant was on bail at the time of issuing the process aforesaid against the appellant. The impugned order has been passed without serving the notice upon the applicant and satisfying itself with the service of notice. In view of the above facts and circumstances, the application is disposed of and the orders dated 31.5.2024 and 13.5.2025, passed by Additional Chief Judicial Magistrate, Kanpur Nagar, in Complaint Case No. 8 of 2024 (Smt. Pinki v. Shivram and Others), under Sections 323, 504, 506, 498A of IPC, Police Station Kohna, District Kanpur Nagar, shall be kept in abeyance with the condition that the applicant will present in the aforesaid case on the next date of listing in the court concerned.
