PUBLIC PROSECUTOR The Court made the following: 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 1533 of 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioners herein/A3 & A5, seeking regular bail, in Crime No.62 of 2024 of Pedabayalu Police Station, registered for the offences punishable under Sections 111(2) (b) of BNS, Sections 20(b)(ii)(C), 25 read with 8(c) of the NDPS, Act. 2. Brief facts of the case are that, on 15.12.2024 at about 16.30 hours, on receipt of credible information, the SI of Police, Pedabayalu Police Station, along with his staff and mediators rushed to near Sampangiputtu village Main Road, Adugulaputtu Panchayat of Pedabayalu Mandal and conducted vehicle checking. Meanwhile, one car coming from Kujabangi Side to Pedabayalu, on seeing the police party, they stopped their vehicle and got down, tried to escape. The Police have apprehended two persons i.e., A3 and A5 and seized 100 Kgs of Ganja from their possession along with other material under the cover of mediators report and Consequently, a Case has been registered against the accused and others. 3. Heard learned counsel for the petitioners and the learned Assistant Public Prosecutor representing the respondent/State. Perused the material on record. 4. The petitioners were caught while transporting 100 kgs of Ganja which is a commercial quantity. Learned Assistant Public Prosecutor submits that 3 the investigation is not completed. The Petition filed before the Trial Court was dismissed. Learned Assistant Public Prosecutor vehemently opposed the petition in the light of Section 37 of NDPS Act. In view of the aforesaid facts and circumstances of the case, this Court does not find any grounds to consider the case of the Petitioners. 5. Accordingly, the Criminal Petition is dismissed.
