1. The instant petition has been filed for seeking direction to the respondents to fill up five posts of EWS Category which remained vacant due to non availability of the candidates from the said category.
2. Learned senior counsel appearing on behalf of the petitioners claims that as per the standing instructions from the Govt., in case the EWS General Category posts remain unfilled on account of want of suitable candidates, the said posts are to be filled up from the available General Category candidates. CWP NO.18105-2024(O&M) 2 respondents have not considered the petitioners for such appointment, hence the instant writ petition has been filed.
3. It is pointed out that the respondents have, in the meanwhile, accepted the claim of the petitioners and the Haryana Public Service Commission – respondent no.3 has made a recommendation to the State Govt. on 18.07.2025 by modification of result declared on 07.06.2024. To the said extent, the instant writ petition has been rendered infructuous. He, however, contends that the notional benefits of seniority and re-fixation may be granted to them w.e.f the date when letters of appointment were issued to the other persons whose notional benefits have been released from the date of their actual appointment.
4. The formal reply on behalf of respondents no.3 and 4 would not be required.
5. Taking into consideration the above, the instant writ petition is
disposed of as having been rendered infructuous. The respondents are further
directed to grant the notional benefits of seniority and pay fixation w.e.f the date other persons had joined consequent upon declaration of result on 07.06.2024 and actually with effect from the date when appointment letters were issued.
6. Let the needful be done by the respondents within a period of three months from the date of receipt of certified copy of this order. 21.07.2025
