Neutral Citation No. - 2025:AHC:116820 Court No. - 68 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 24004 of 2025 Applicant :- Vijay Singh Opposite Party :- State of U.P. Counsel for Applicant :- Kamlesh Kumar Tripathi Counsel for Opposite Party :- G.A. Hon'ble Arun Kumar Singh Deshwal,J. 1. Heard Sri Kamlesh Kumar Tripathi, learned counsel for the applicant, Sri Raj Bahadur Verma, learned A.G.A. for the State and perused the record. 2. The instant bail application has been filed with a prayer to release the applicant on bail in Case Crime No. 61 of 2016, under Sections 395, 412, 342, 413 I.P.C., Police Station- Ikdil, District- Etawah, during the pendency of the trial. 3. Contention of learned counsel for the applicant is that applicant was released on bail on 26.06.2016. Applicant is absconding since 2017. Thereafter, warrant was issued against the applicant. Learned counsel for the applicant submitted that the applicant is languishing in jail since 23.06.2024. In case, he is granted bail, he will not misuse the liberty of bail and would cooperate in the trial proceedings. 4. Per contra, learned A.G.A. has vehemently opposed the prayer for bail on the ground that applicant has criminal history of 30 cases and and he is absconding since 2017. He is not cooperating in the trial and therefore, applicant is not entitled to be released on bail. 5. From the submissions of learned counsel for the parties and perusal of record, it is clear that applicant is absconding since 2017 and he was again involved in heinous criminal cases which includes attempt to murder, murder, robbery and on 3 occasions, gangsters act was also invoked against the applicant and the fact that applicant immediately after getting bail, was again involved in heinous offences though he was released on bail with the condition that he will not commit further offence but the applicant kept on committing several offences in violation of the bail condition. 6. Therefore, considering the long criminal history of 30 cases of the applicant and taking into account the serious nature of offences involved therein, and to prevent him from committing further offences and also for ensuring his presence during trial of cases pending against him, it would be appropriate that applicant should not be released on bail at this stage. Therefore, this Court is not inclined to grant bail to the applicant. 7. Accordingly, the bail application is rejected at this stage. 8. However, considering the fact that applicant is involved in several criminal cases, the District Judge, Etawah, is directed to conclude the trial of Special Case No. 190 of 2016 in Case Crime No. 61 of 2016 u/s 395, 412, 342, 413 I.P.C., Police Station- Ikdil, District- Etawah, pending in the court of Special Judge (Dacoity Affected Area)/ Additional Sessions Judge, Court No.3, Etawah, as expeditiously as possible, in accordance with law.
