JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.1 under Section 439 of Code of Criminal Procedure praying to grant bail in S.C.No.127/2021 pending on the file of I Additional District and Sessions Judge, Mandya registered for offences punishable under Sections 397 and 511 of Indian Penal code arising out of Crime No.24/2021 of Mandya Rural Police Station. 2. Heard the learned counsel for petitioner and learned Additional State Public Prosecutor for respondent - State. 3. Learned counsel for petitioner would contend that, the petitioner was earlier granted bail vide order dated 19.02.2022 and after he furnished surety, he has - 3 - HC-KAR NC: 2025:KHC:43431 CRL.P No. 13375 of 2025 been released on bail on 14.06.2022. Subsequently, he remained absent for one date i.e., on 27.06.2024 and NBW came to be issued against him. By executing NBW, he has been produced before the Sessions Court on 12.12.2024. The petitioner could not appear before the Court for unavoidable circumstances. The petitioner is ready to appear before the Trial Court on all dates of hearing and cooperate for speedy disposal. With these, he prayed to allow the petition. 4. Per contra, learned Additional State Public Prosecutor would contend that, the petitioner has violated the bail conditions and therefore, his bail petition has rightly been rejected by the Sessions Court. If the petitioner is again granted bail, he will remain absent and hamper the trial. With these, she prayed for dismissal of the petition. 5. Having heard the learned counsels appearing for the parties, the Court has perused the materials placed on record. - 4 - HC-KAR NC: 2025:KHC:43431 CRL.P No. 13375 of 2025 6. The petitioner is facing Trial in S.C.No.127/2021 for offences under Sections 397 and 511 of IPC. The petitioner was granted bail vide order dated 19.02.2022 and he has been released on 14.06.2022. Subsequently, on multiple occasion, he remained absent and NBW has been issued and it has been recalled. The petitioner remained absent on 27.06.2024 as no exemption application is filed, NBW has been issued against him and by executing NBW, he has been produced before the Sessions Court on 12.12.2024. The petitioner is in judicial custody since 12.12.2024. The petitioner has undertaken to appear before the Trial Court on all dates of hearing unless exempted and cooperate for speedy disposal. 7. Considering all the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following; ORDER This Criminal Petition is allowed. The petitioner/accused No.1 is granted bail in S.C.No.127/2021 - 5 - HC-KAR NC: 2025:KHC:43431 CRL.P No. 13375 of 2025 pending on the file of I Additional District and Sessions Judge, Mandya arising out of Crime No.24/2021 of Mandya Rural Police Station, subject to following conditions: i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the likesum to the satisfaction of the Trial Court. ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. iii) The petitioner shall appear before the Trial Court on all the dates of hearing unless exempted by the Court and cooperate for the speedy disposal of the case.
