ORDER This Criminal Revision Case has been preferred against the order dated 03.03.2025 passed in M.P.No.1606 of 2024 in M.C.No.164 of 2024 Page No.1 of 5 https://www.mhc.tn.gov.in/judis
Crl.R.C.No.1053 of 2025 by the VII Additional Principal Family Court at Chennai, thereby ordering interim monthly maintenance of Rs.30,000/- in favour of the respondents. 2. Heard the learned counsel appearing for the petitioner and also perused the materials available on record. 3. The marriage between the petitioner/husband and the 1st respondent/wife was solemnized on 09.03.2015 and out of the wedlock, one male child namely Thanush/2nd respondent herein was born to them. The petitioner is employed in USA as Data Base Administrator at PPG Health Care at USA and earning USD 8,000/-. While being so, there was a misunderstanding between them and the respondents were driven out from the matrimonial house. Hence, the respondents have filed a maintenance case u/s 125 of Cr.P.C. in M.C.No.164 of 2024 on the file of VII Additional Principal Family Judge, Chennai, claiming monthly maintenance of Rs.69,785/-, in which the respondents filed a petition u/s 144(2) BNSS, 2023 in M.P.No.1606 of 2024 in M.C.No.164 of 2024 claiming interim maintenance of Rs.45,000/- p.m. till the disposal of M.C. Crl.R.C.No.1053 of 2025 interim monthly maintenance to the respondents and directed the petitioner to pay a sum of Rs.25,000/- towards litigation expenses to the respondents. Aggrieved by the same, the present revision is filed by the petitioner/husband. 4. The learned counsel appearing for the petitioner submitted that the petitioner's salary is only 380.54 dollars, in which after deducting the expenses, he is having only 100 dollars p.m. Therefore, he would not be able to pay such a huge amount of maintenance ordered by the trial court. Hence, he prays for allowing this revision. 5. Admittedly, the specific case of the respondents is that the petitioner is earning 6000 dollars p.m. by working in USA. Though the petitioner admitted that he is earning nealy 4000 dollars, he did not produce any documents to show that he earned that much. It is true that the petitioner is working in USA and receiving reasonable salary. Therefore, the Trial Court rightly awarded interim monthly maintenance of Rs.25,000/- in favour of the respondents, which cannot be said to be on the higher side.

In view of the above, this Court does not find any infirmity or illegallity in the order dated 03.03.2025 passed by the VII Additional Principal Family Court, Chennai in M.P.No.1606 of 2024 in M.C.No.164 of 2024. 7.
