Neutral Citation No. - 2025:AHC:108498 Court No. - 49 Case :- WRIT - B No. - 2551 of 2025 Petitioner :- Ramesh Singh And 2 Others Respondent :- State Of U.P. And 11 Others Counsel for Petitioner :- Ajeet Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble J.J. Munir,J. The Board have allowed a revision and remanded the delay condonation matter to the Additional Collector (Finance & Revenue), Rasra, District Ballia where the Additional Collector condoned a delay of 14 years in making a restoration application against the order dated 14.09.2001 passed in proceedings under Section 28 of the Land Revenue Act. The original order that is claimed to be made ex parte was passed on 14.09.2001 whereas the restoration application was filed on 29.09.2015. A perusal of the Additional Collector's order show that he has rather acted casually in condoning the delay. We do not mean to say that the delay cannot be condoned, but it requires due
consideration. The Board, in passing the impugned order, has required due consideration of the parties' case. We do not desire to burden the Additional Collector with a further remarks of ours except that he should decide the delay condonation matter in proceedings that have been decided ex parte under Section 28 of the Land Revenue Act, afresh after hearing all parties and considering all necessary evidence. Subject to the above remarks but without interfering with the impugned order passed by the Board, this petition is disposed of.
Let this order be communicated to the Additional Collector (Finance and Revenue), Rasra, District Ballia through the learned Chief Judicial Magistrate, Ballia by the Registrar (Compliance) within 24 hours.
