HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 24200 of 2025 Court No. - 87 HON'BLE SANTOSH RAI, J.
1. Short counter affidavit filed, today in Court, by learned counsel for the informant is taken on record. 2. Heard learned counsel for the applicant, learned counsel for the informant and learned AGA for the State-respondents and perused the record. 3. This bail application has been moved on behalf of accused-applicant Shyam Varshney seeking enlargement on bail in Case Crime No.538 of 2024, under Section 109(1) B.N.S. and 4/25 Arms Act, Police Station- Dibai, District- Bulandshahar. 4. Learned counsel for the applicant submitted that applicant is innocent and has been falsely implicated in this case due to ulterior motive. He submits that the FSL report has not been received yet. The progress of the trial is going on and so far four prosecution witnesses have been examined before the trial court. It is argued that the applicant is languishing in jail since
14.10.2024. Hence bail has been prayed for. 5. Learned A.G.A. as well as learned counsel for the informant has vehemently opposed the submission of learned counsel for the applicant and submits that accused applicant has committed a very serious offence. He further submits that the applicant has caused injury on the vital part of the injured with a sharp weapon knife. As per the medical evidence/statement of Dr. Ankur Rawat and Dr. Harendra Singh the intestine of the injured came out from the stomach. and bleeding was present at the time of treatment. The nature of injures are quoted below:- Versus Counsel for Applicant(s) :
Counsel for Opposite Party(s) :
Shyam Varshney .....Applicant(s) State of U.P. .....Opposite Party(s)
"Ear-No active bleeding at Rt. ear WNL, in instal Lt. ear- cut through laceration starting 1 cm above and anterior to root of helic involving cyndra concha going medially to involve conchal eminence extending 10 cm posteriorly involving mestoid blood cloths (+) in ear, TM not nose neck and oral cavity WNL"
6. From the perusal of the medical report/injury report it transpires that multiple sharp weapon injuries were caused by the applicant on the vital part of the injured. The injured in the statement recorded before the I.O. has specifically stated that accused applicant has caused multiple grievous injury on his vital parts and during the course of trial the injured again supported his previous statement.
7. Without expressing any opinion on merits of the case and considering the submissions advanced, the nature of injury and gravity of the accusation, I find no good ground to grant bail to the applicant in the aforesaid case, at this stage. 8. The bail application is, accordingly, rejected. 9. The trial Court is directed to proceed the trial in view of Section 309 Cr.P.C. and to conclude the trial expeditiously, from the date of production of certified copy of this order without granting unnecessary adjournment, if there is no legal impediment.
