1. Heard Mr. Rajbahadur Singh, learned counsel for the petitioner. Also heard Mr. Nitansh Kumar Jaiswal, learned Panel Lawyer, appearing for the Respondent/State. 2. The present petition has been filed by the petitioner with the following prayer:
"It is, therefore, prayed that this Hon'ble Court may
2 kindly be pleased to allow this petition and quash the FIR as well as entire charge-sheet filed against the petitioner by the Police of Police Station- Gunderdehi, District- Balod (C.G.) in connection with Crime No. 388/2022 and which is pending before the Judicial Magistrate First Class, Gunderdehi, District - Balod (C.G.) under Section 420, 34 of I.P.C. as Criminal Case No. 50/2025, in the interest of justice."
3. On perusal of the prayer in the present petition, it transpires that the present petition is drafted with the prayer which is defective one, therefore, we are not inclined to entertain the present petition with such a vague and sketchy prayer as there is no mention of the date of charge-sheet and no challenge of order taking cognizance to which learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with a liberty to file afresh with proper prayer. 4. Learned State counsel has no objection. 5. In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for subject to depositing a sum of Rs. 2,000/- as cost by the petitioner in the Registry of this Court within a period of one week from today and the said amount shall be transmitted to the Government SAA, Balod (C.G.). 6.
Certified copy, if any, filed in the petition be return back to the petitioner after retaining its attested true copy. Sd/- Sd/- (Ravindra Kumar Agrawal) (Ramesh Sinha) Judge Chief Justice Alok ALOK SHARMA Digitally signed by ALOK SHARMA Date: 2025.02.10 19:10:59 +0530
