1. The petitioner is before this Court seeking for the following reliefs:
“A) Appoint an independent sole arbitrator from the panel of arbitrators from Arbitration Center, Bangalore., Agreement date 08/02/2023 (Annexure-A) As per clause 12.
B) Pass such other and further order/s as may be deemed fit in the interests of justice and equity.”
2. After arguing for some time, both the learned counsel submit that an Arbitrator could be appointed by this Court, keeping all the contentions open.
3. In that view of the matter, I pass the following:
ORDER i. CMP is allowed. ii. Hon’ble Sri. P.N.Desai, a former Judge of this Court is appointed as a sole Arbitrator to arbitrate the dispute between the parties under

the aegis of the Arbitration Centre attached to this Court. iii. All contentions including that of arbitrability are left open to be decided by the learned arbitrator. iv. Registry is directed to forward a copy of this
order to the Director, Arbitration and Conciliation Centre for doing the needful and also directed to return the originals / certified copies of the documents filed to the petitioner on compliance with the formalities. v. Since the order is passed in the presence of both the counsel, they shall appear before the Director, Arbitration and Conciliation Centre without requirement of any notice on 27.11.2025 at 2.30 p.m.
