SHRI. SANTHOSH P.PODUVAL, SC, THRISSUR CORPORATION D.KISHORE RAJIT THIS WRIT PETITION (CIVIL) HAVING BEEN FINALLY HEARD ON 04.04.2025, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:
2025:KER:28992 WP(C) NO.3418 OF 2018 3 MOHAMMED NIAS C. P. , J. ………………………………………….
W. P. (C) No. 3418 OF 2018 ………………………………………………. Dated this the 04th day of April, 2025 J U D G M E N T The petitioner challenges Ext.P6 order passed by the 3rd respondent which considered the dispute between the petitioner and the 4th respondent as regards an electric post bearing No.DSR 27/2, allegedly adjacent to the compound wall built by the petitioner. Through Ext.P2 order, the Consumer Grievance Redressal Forum
directed the licensee to take appropriate action. Thereafter Ext.P5
order was passed on 01.01.2018 by the 2nd respondent, stating that the complaint raised by the 4th respondent is without any basis. However, through Ext.P6 dated 10.01.2018 issued by the 3rd respondent, the petitioner was directed to re-construct a compound wall, in order to replace the electric post in question. A reading of Exts.P5 and P6 shows that they contradict each other.
2. Under such circumstances, Ext.P6 is quashed and I direct the competent authority in the first respondent Corporation to
2025:KER:28992 WP(C) NO.3418 OF 2018 4 reconsider the issue with notice to the petitioner and the 4th respondent. Fresh orders as directed above shall be passed within six weeks from today. The status quo as of today shall be maintained, till a decision is taken, as directed above. The writ petition is disposed of as above. SD/- MOHAMMED NIAS C.P., JUDGE JJ
