The present writ petition has been filed praying for a direction to the respondent-authorities to remove encroachment from the petitioner's land bearing Gata No. 161 area 250 sq yard, Village Shobhapur Tehsil Modinagar District Ghaziabad. 2. Case of the petitioner is that the aforesaid land was allotted to him by S.D.M., Modi Nagar vide order dated 23.05.1996 in pursuance of certain directions issued by the National Human Rights Commission. In support of said plea, reliance has been placed on Khatauni filed as Annexure 1 to the writ petition. The Revenue Authorities have supplied written instructions and according to which as per revenue records, there is no allotment in favour of the petitioner. It is also stated that one Siya Nand had filed a suit against the petitioner claiming allotment of the same land in his favour. The said suit has been dismissed, for non-prosecution. 3. The petitioner admits that he has also instituted a civil suit against Siya Nand and the said suit was later on withdrawn by him.
