Seeking setting aside of the order/letter dated 14.11.2017 (Annexure P-10), whereby the technical pay-scale of Rs.1200-2040 was declined to the petitioners, the instant writ petition has been filed.
Learned counsel for the petitioners relies on the judgment dated 25.03.2025 passed by a Division Bench of this Court in a bunch of writ petitions including CWP No.11710-2014 titled as ‘Sarbans Singh and Others Versus State of Haryana and Others’. He further submits that the petitioners would be satisfied at this juncture, in case the respondents are directed to reconsider the claim of the petitioners as per law and in light of the abovesaid
judgment.
Considering that the issue raised by the learned counsel for the petitioners has already been adjudicated upon in the judgment dated 25.03.2025 passed in the matter of Sarbans Singh and Others (Supra) and retrospective RAJENDER KUMAR 2025.08.04 06:26 I attest to the accuracy and authenticity of this order

-2- application of Sections 3 and 4 of the Haryana (Abolition of Distinction of Pay Scale between Technical and Non-Technical Posts) Act, 2014 to the erstwhile employees has been held to be bad, the order/letter dated 14.11.2017 (Annexure P-10) impugned herein is set aside and a direction is issued to the respondents to reconsider the claim of the petitioners as per law and in light of the judgment dated 25.03.2025 passed in the matter of Sarbans Singh and Others (Supra) and to take an appropriate decision by passing a reasoned and speaking order within a period of three months of the receipt of certified copy of this order.
Needless to say that upon reconsidering the claim of the petitioners, if any dues, including towards retiral benefits, are found payable to petitioners, the same be also released in their favour within a further period of two months.
Petition stands allowed accordingly.
