JUSTICE PRAVEER BHATNAGAR
Order 27/02/2025
1. Apprehending his arrest in connection with FIR No. 14/2025 registered at Police Station Aandhi, District Jaipur Rural for the offence(s) under Sections 8/15 and 8/20 of NDPS Act, the petitioner has preferred this anticipatory bail application under Section 482 of BNSS.
2.
Learned counsel for the accused-petitioner submits that petitioner has falsely been implicated in this case. Accused- petitioner has been involved solely on the basis of disclosure statement of other co-accused, the same is not admissible. No recovery was effected from the petitioner’s possession and the recovered quantity of contraband articles from the possession of other co-accused is below commercial quantity. There are no criminal antecedents against the petitioner and petitioner is ready and willing to cooperate with the investigation. He further submits that no custodial investigation of the accused petitioner is
(2 of 3) [CRLMB-2301/2025] required. He prays that the anticipatory bail of accused-petitioner may be allowed.
3. Learned Public Prosecutor vehemently opposes the bail application.
4. I have considered the overall allegations levelled in the FIR and contentions made by the counsel for the parties.
5. Recovery of contraband articles were effected from the other co-accused and accused-petitioner was involved solely on the basis of disclosure statement of other co-accused, there is no evidence available on record that petitioner supplied contraband articles to the other co-accused, without expressing anything on merits of the case and looking to the fact that custodial investigation of the present petitioner is not required, I deem it just and proper to allow the anticipatory bail application of the accused-petitioner.
6. Accordingly, the anticipatory bail application under Section 482 BNSS is allowed and it is ordered that in the event of arrest of the petitioner- Jogendra @ Kaluram S/o Kalluram, in connection with FIR No. 14/2025 registered at Police Station Aandhi, District Jaipur Rural he shall be released on bail, provided he furnishs a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioner shall make himself available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to
(3 of 3) [CRLMB-2301/2025] the court or any police officer, and (iii) that the petitioner shall not leave India without previous permission of the court.
