Ms. Sadaf, learned counsel for the applicant. 2. Ms. Pushpa Bhatt, learned Dy. A.G. for the State. 3. Present applicant Riyaz is praying for regular bail in relation to the FIR dated 12.05.2025 registered as FIR No. 208 of 2025 at P.S. Bahadrabad District Haridwar wherein the present applicant has been implicated for the offence punishable under Sections 196 and 299 of BNS 2023. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated. She further submits that the applicant has no previous criminal history. 5. As per the prosecution case, which is evident from the FIR dated 12.05.2025, lodged at P.S. Bahadrabad District Haridwar when Addl. S.I. Karam Singh along with Cons. 596 Ankit Kumar and Cons. 1284 Avnesh Rana were on patrolling duty and checking suspicious vehicles, they got information from some local people that one Riyaz , S/o Fateh Mohammad resident of village Badheri Rajputan , P.S. Bahadrabad , who is aged about 32 years making indecent and objectionable comment about Lord Rama (Bhagwan Ram) and Goddess Sita (Mata Sita) from his instagram ID https://www.instagram.com/riyaz.kha.581 1?igsh=znc0ew13y24lbwe5. Such comment made by the applicant through his ID is hurting the faith of the followers of Hindu Religion. On such information they reached at the spot and they found that Riyaz was standing and when they asked why he made that objectionable 2025:UHC:4545 comment from his instagram account then he said that he will do the same in future also. 6. The allegation, as apparent from the face of the FIR, appears to be very serious in nature. The present applicant belongs to a different religion but the manner in which he made that objectionable comment from his instagram account and thereafter stated that he will repeat the same in future also appears to be very serious and such an attempt certainly is nothing but an alarming situation and nobody has a right to hurt the faith of the followers of the other religion. 7. Thus, keeping in view the seriousness of the allegations, I do not find any ground to enlarge the applicant on bail. 8. Accordingly, the bail application is rejected.
