3. Sri. Varun Patil, learned counsel appearing for the petitioner contended by referring to Clause 16 of the License Agreement dated 19.01.2017 and also refers to the notice dated 27.09.2021 (Annexure-F) sought for appointment of the Arbitrator to resolve the dispute.
4. Sri. Madhukar S. Deshpande,

No.18) and therefore, he argued that, the petition does not survive for consideration. 5. Having taken note of the submissions made by the learned counsel appearing for the parties and upon perusal of Clause 16 of the License Agreement dated 19.01.2017, though the said provision provides for appointment of the Arbitrator at the instance of the respondent herein, however, the same cannot be accepted on the ground that the sole Arbitrator who has been appointed therein is a personnel of the respondent establishment. In that view of the matter, I am of the considered opinion that, an independent and impartial Arbitrator is to be appointed to adjudicate the dispute between the parties. It is also to be noted that, the appointment of Arbitrator by the respondent would affect scope and ambit of Section 12(5) of the above Act. - 5 -
