Heard learned counsel for the parties and perused the record. 2. The instant writ petition has been filed for following relief: "Issue an appropriate writ, order or direction commanding the Court of Civil Judge (Junior Division), Koil, District Aligarh to decide the Misc. Case No. 171 of 2024 filed under Order 9 Rule 13 r/w Section 151 C.P.C. for recalling an ex-parte order dated 23.07.2024 filed in Original Suit No. 379 of 2023 (Raj Pal Singh and another vs. Raja Jitendra Pal Singh and others) expeditiously preferably on the next date fixed and till then the parties may be directed to not to interfere in the peaceful use, occupation and possession of the petitioner over the land contained in Gata No. 304 admeasuring 0.691 hectares situate at Mauja Vijaygarh Dehat, Pargana Akarabad, Tehsil Koil District Aligarh." 3. Contention of the learned counsel for the petitioner is that the aforementioned case is pending for adjudication. He prayed that the same may be decided expeditiously. 4. No useful purpose would be served in keeping this petition pending. 5. The present petition stands disposed of finally with a direction to the Civil Judge (Junior Division), Koil, District Aligarh to consider and decide the aforementioned case of the petitioner, in accordance with law, expeditiously, preferably within a period of twelve weeks from the date of production of a certified copy of this order after ensuring service upon all the respondents, after giving opportunity of hearing to the parties concerned and after giving a reasonable opportunity of leading evidence in respect of their case provided that there is no other legal impediment.
