This application under Section 483 Cr.P.C. has been filed with a prayer to direct the court concerned to decide the Criminal Case No. 55439 of 2021 in case crime no. 614 of 2020 under Sections 147, 148, 323, 352, 325 I.P.C., Police Station- Gorakhnath, District- Gorakhpur pending in the Court of learned Additional Chief Judicial Magistrate, First, Gorakhpur expeditiously within stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is fairly conceded by the learned counsel for the applicant before this Court that the applicant has not appeared before the Court. 4. The attention of the Court is drawn to an order passed in an Application U/S 483 Cr.P.C. No. 1573 of 2024 wherein a co- ordinate Bench of this Court has dismissed the application of the present applicant on the ground that the accused is yet to appear before the trial Court and the position is the same as yet. Since the similar application has already been dismissed by the co-ordinate Bench of this Court vide order dated 2.9.2024 there is no justification to allow the present application. 5.
