JUSTICE SANDEEP KUMAR ORAL ORDER 2 17-09-2025 Heard the learned Senior Counsel for the petitioners and learned APP for the State. 2. The petitioners seek regular bail in connection with Bhore P.S. Case No. 71 of 2025 registered for the offence under Sections 103 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. As per the prosecution case, it is alleged that there was illicit relation of petitioner no. 2 with the brother of the deceased and when the deceased opposed the illicit relationship then the petitioners had assaulted the deceased badly due to which the deceased died. 4. The petitioner no. 1 and the petitioner no. 2 are the brother and sister. Both are said to have participated in the Patna High Court CR. MISC. No.63407 of 2025(2) dt.17-09-2025 2/2 killing of the deceased. Independent witnesses have supported the occurrence. The petitioners are in custody since 07.03.2025. 5. Considering the fact that the petitioner no. 2 is a woman as well as her period of custody, her prayer for regular bail is allowed. 6. Accordingly, let the petitioner no. 2, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Gopalganj/concerned Court below in connection with Bhore P.S. Case No. 71 of 2025. 7. So far as the petitioner no. 1 is concerned, considering the allegations levelled against him and also considering the gravity of the offence, I am not inclined to grant regular bail to the petitioner no.1. 8. Accordingly, his prayer for regular bail stands rejected. 9. In view of the discussions made above, the application stands disposed of. Shishir/- (Sandeep Kumar, J) U T
