JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs; a. "Issue a Writ of Certiorari or any other writ Quashing the e-auction sale notice dated 02.10.2024 as published in the news paper as produced in Annexure A and Al issued by the Respondent No.1 as contrary to the law. b. Issue Direction to the Respondent No.1 for re- auction giving wide publication in a leading news papers so as to get the best market value to the assets being auctioned for to meet the ends of justice. c. Issue any other writ or direction as this Hon'ble Court may deem fit in the facts and circumstances of the case." 2. A memo dated 30.10.2025 has been filed, signed by the learned counsel for the petitioner, which reads as under; MEMO The undersigned Counsel for the Petitioner submits as follows: 1. That the Petitioner has challenged the e-auction notice dated 02.10.2024 issued by the Respondent - 3 - HC-KAR NC: 2025:KHC:46355 WP No. 27539 of 2024 No.1. It is submitted that matter is listed before this Hon'ble Court for hearing today. 2. That there is a settlement entered into between the Respondent No.2 and the Petitioner. By virtue of the said settlement, the Petitioner intends to withdraw the said petition. Wherefore, the Petitioner most humbly prays that this Hon'ble Court may be pleased to consider and take this memo on record and allow the Petitioner to withdraw the instant petition, in the interest of justice and equity. 3. Accepting the said memo and submission of learned counsel for the petitioner, the petition is dismissed as withdrawn. 4.
