In view of the order which is being proposed to be passed, notice is not being issued to the opposite party no. 2. 3. The sole prayer made in the present application is to direct the Learned A.E.J. /J.D./ Court No-5 Jhansi to decide the Complaint Case No.- 140/2022, (Dinesh Mishra Vs Deep Upadhyay @ deep Chandra Upadhyay), under section 138 Negotiable Instruments Act Police Station- Nawa bad, District- Jhansi within stipulated time, pending before him since 21.12.2022. 4. Learned counsel for the applicant submits that despite the fact that the proceedings are pending but the same has not given a logical end. 5. Learned AGA has no objection to the same. 6. Considering the submission raised at bar, the application stands disposed of requiring the court below to expedite the proceedings and to decide the same in terms of sub-section (3) of Section 143 of the NI Act subject to legal impediment, if any.
