JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 11-09-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State. 2. The petitioners apprehend their arrest in a case registered for the offence under Sections 191(2), 191(3), 190, 115(2), 126(2), 109, 76, 352, 351(2), 3(5) of the Bhartiya Nyaya Sanhita. 3. As per F.I.R., on 09.03.2025 at about 7 AM, informant was sitting at her door, in the meantime, all the F.I.R. named accused persons including these petitioners came, armed with lathi, danda, knife and desi Katta, started abusing her and when son of informant protested, co-accused Manish Kumar Patna High Court CR. MISC. No.62094 of 2025(2) dt.11-09-2025 2/3 assaulted him with knife and her daughter. It is further alleged that co-accused Manish Kumar went to roof of his house and fired from his desi katta, however no one sustained any fire-arm injury and thereafter, co-accused Golu Kumar and Niru Kumari snatched Mangalsutra and co-accused Mahima Kumari snatched mobile phone from the informant. 4. Learned counsel for the petitioners submits that from bare perusal of F.I.R. itself, the specific accusation of committing assault and firing is against co-accused Manish Kumar. So far as these petitioners are concerned, there is absolutely no allegation of assault against them. Petitioners claim clean antecedent. 5. Learned A.P.P. for the State has opposed the bail petition. 6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Saran at Chapra in connection with Isuapur P.S. Case No. 50 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Patna High Court CR. MISC.
