Sri Shamim Ahmad Ansari, learned counsel for the applicants submits that though the application has been preferred to quash the summoning order dated 16-07-2018 passed by Chief Judicial Magistrate, Mahoba, in Complaint No. 558 of 2018 (Computerized Registration No. 161 of 2018) (Shahadat Husain Vs. Rajendradhar Dubey and others), under section 138 Negotiable Instrument Act, Police Station Kotwali Charkhari, District Mahoba, pending in the court of Civil Judge (J.D.)/Judicial Magistrate, Charkhari, Mahoba, however, he confines his relief to a direction to the court below to consider the legal submissions and the contentions raised by the applicants with regard to the maintainability of the complaint on the premise that the society was not arraigned as one of the accused. 3. Shri Ram Awadh Mauray, learned State Law Officer has no objection to the same. 4. Considering the submissions raised at the Bar, the application stands disposed of granting liberty to the applicants to contest the proceedings taking all legal and factual grounds, then this Court has no reason to disbelieve that the same shall be decided with most expedition.
