04.12.2025 Court No.35.
D/L. 22. Kausik (Rejected)
CRM (NDPS) 1561 of 2025
In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Berhampore Police Station Case No. 611 of 2025 dated 23.03.2025 under sections 20(b)(ii)(C)/29 of the NDPS Act, 1985;
And In the matter of : Sukur Ali Mondal @ Sk. Sukur Mondal
……Petitioner.
Mr. Sourav Mondal
Mr. Arijit Bhuiya
Mr. Rony Mondal
Ms. Sudeshna Mukherjee
……for the Petitioner.
Mr. Joydeep Biswas
Ms. Dhanasree Biswas
……for the State.
Learned advocate appearing for the petitioner submits that unnecessarily the petitioner is languishing in jail for more than 8 months and till date no efforts have been made to commence the proceedings. Unnecessarily petitioner is detained in custody. Learned advocate for the State, on the other hand submits that 142 Kgs. of Ganja were seized from the petitioner and others. In view of the quantity of contraband seized, I am of the opinion that the rigors of Section 37 of the NDPS Act is attracted.
2 Consequently, the prayer for bail in CRM (NDPS) 1561 of 2025 is dismissed. Learned Special Court is directed that in case any accused is absconding, processes be exhausted and if required the trial be split up at the earliest. Learned Trial Court would ensure that the trial of the case is taken to its logical conclusion within a reasonable period of time. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
