GP FOR HOME (AP) The Court made the following order: This Writ Petition under Article 226 of the Constitution of India is filed for the following relief: “to issue an appropriate Writ Order or direction more particularly in the nature of Writ of Mandamus to declare the inaction of respondent 2 and 3 in not providing police protection for conducting survey of petitioners land is illegal orbitary and against the natural Justice and violation of 2 Article 14 19 21 and 300A of Constitution of India and consequently direct the Respondents 2 and 3 to provide necessary Police Protection to conduct the survey of land in survey no 78/1 to an extent of 0 61 acrs and survey no 782A to an extent of 2 67 acrs of Kodimi Village of Ananthapuramu Mandal Ananthapuramu District and pass such...” 2. Heard learned counsel for the petitioner and learned Additional Government Pleader appearing for the State. 3. Learned Additional Government Pleader appearing for the State on instructions would submit that the Mandal Revenue Officer vide Letter dated 20.09.2023 (Ex.P5) requested the Station House Officer, Ananthapuramu Rural Police Station to provide necessary police protection to staff of Mandal Revenue Officer on 26.09.2023, for conducting a survey of the land. But as on the date, no further request was received from the Mandal Revenue Officer, subsequent to the above letter and therefore, the Writ Petition is not maintainable as on the date. 4. Considering the above facts and circumstances, as undisputedly no letter was received by the Station House Officer subsequent to the above letter particularly, as on the date of Writ Petition, this Court is of the considered opinion that the Writ 3 Petition can be disposed of at the stage of admission itself, without going into merits of the case, by directing the respondent/ Police to follow due procedure established under law, in the event of receipt of any letter from MRO, in future, with regard to police protection, for survey of the land. 5. 5.
