Sri Shamim Ahmad Ansari, learned counsel for the applicant submits that though the application has been preferred to quash the entire proceeding of Complaint No. 1930 of 2019 -(Shivendra Yadav Vs. Rajendra Dhar Dubey) as well as summoning order dated 28-09-2019 passed by Additional Chief Judicial Magistrate, Maharajganj in Complaint No. 1930 of 2019 (Shivendra Yadav Vs. Rajendra Dhar Dubey), under section 138 Negotiable Instrument Act, Police Station Parsamlik, District Maharajganj, however, he confines his relief to a direction to the court below to consider the legal submissions and the contentions raised by the applicants with regard to the fact that the statutory demand notice issued on 24.07.2018 and the complaint was preferred on 06.08.2018 within 15 days. 2. Shri Ram Awadh Mauray, learned State Law Officer has no objection to the same. 3. Considering the submissions raised at the Bar, the application stands disposed of granting liberty to the applicant to contest the proceedings taking all legal and factual grounds, then this Court has no reason to disbelieve that the same shall be decided with most expedition.
