THIS APPEAL COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED:
CONCILIATION ORDER
We mark the presence of Sri. Manjunath G., Zonal Manager of Respondent No.1-Liberty Videocon General Insurance Company. 2. After prolonged negotiations, the matter is settled. A joint memo signed by the learned counsel for the appellant/ claimant (being authorized by the appellant/claimant to sign) and
3 by the Authorized Officer of Respondent No.1, duly signed by its counsel, is filed before the Lok Adalath. 3. The appellants-claimants have agreed to receive and the Respondent-Insurance Company has agreed to pay a lump-sum of Rs.4,65,000/- (Rupees Four Lakhs Sixty-five Thousand only), in addition to what has been awarded by the Tribunal, in full and final settlement of the claim. 4. Respondent No.1-Insurance Company has agreed to deposit the said amount before the Tribunal within six weeks from the date of preparation of award, failing which the said amount shall carry interest at the rate of 9% p.a. from the date of default, till the date of deposit. 5.
Out of the enhanced compensation of Rs.4,65,000/-, an amount of Rs.1,50,000/- (Rupees One Lakh Fifty Thousand only) shall be divided/shared in the proportionate/ratio of 50:50 [Rs.75,000/- (Rupees Seventy Five Thousand) each] and shall be released in favour the Appellants/Claimants No.1 & 2, on proper identification. 4
(a) The balance amount of Rs.3,15,000/- (Rupees Three Lakhs Fifteen Thousand each) shall be divided/shared in the proportionate/ratio of 50:50 [Rs.1,57,500/- (Rupees One Lakh Fifty-seven Thousand Five Hundred) each] among Appellants/Claimants No.1 & 2 and invested in their names, in High Interest Yielding Fixed Deposit, in any Nationlised/ Scheduled Bank of their choice, for a period of 02 years. 6. It is clarified that the order of the Tribunal in respect of distribution of the compensation thereof has not been varied. 7. The Miscellaneous First Appeal stands disposed of in terms of the Joint memo. The Judgment and Award of the Tribunal shall stand modified accordingly. Draw up the Award accordingly.
