JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by the petitioner -accused No.1 under Section 482 of BNSS praying to grant anticipatory bail in Crime No.51/2025 of Rajajinagar Police Station registered for offences punishable under Sections 69, 351(2), 3(5) of BNS and Sections 66(C), 66(E) and 67(A) of Information Technology Act, 2000. 2. Heard learned counsel for the petitioner and learned Additional SPP for the respondent –State. 3. Learned counsel for the petitioner would contend that the petitioner is working as PSI in CRPF, at Chathisgarh. The petitioner came in contact with the victim through Instagram and they met in Bangalore. The allegation against the petitioner is that he had sexual intercourse with the victim who is also woman police constable and he recorded the intimate moments in mobile and sent them to his friends and uploaded in social media. - 3 - HC-KAR NC: 2025:KHC:49919 CRL.P No. 14745 of 2025 The petitioner being a Police Officer is ready to co-operate with the police in investigation and abide by any terms and conditions to be imposed by this Court. With this, he prays to allow the petition. 4. Per contra learned Additional SPP for the respondent –State would contend that the statement of the victim has been recorded under Section 183 of BNSS wherein she has specifically stated the acts of this petitioner having sexual intercourse on her, recording the intimate moments, sending them to his friends and uploading in social media. The investigation is in progress. If the petitioner is granted anticipatory bail, he will hamper the investigation and tamper the prosecution witnesses. With this, she prayed to reject the petition. 5. Having heard learned counsels, this Court has perused the FIR, complaint and other materials placed on record. 6. The petitioner and the victim girl came in contact through Instagram. The petitioner is working as - 4 - HC-KAR NC: 2025:KHC:49919 CRL.P No. 14745 of 2025 PSI in CRPF at Chathisgarh and aged 26 years and the victim is lady police aged 28 years working in Bengaluru. As per averments of the complaint, the petitioner and the victim met several times in Bengaluru and petitioner had sexual intercourse on her under the promise of marriage. The petitioner is alleged to have recorded the intimate moments in his mobile and sent them to his friends and uploaded in social media. The investigation is in progress. The petitioner being a PSI in CRPF has undertaken to cooperate with the police in investigation. Offences alleged against the petitioner are not punishable either with death or imprisonment for life. There are no criminal antecedents of the petitioner. Considering the above aspects, the petitioner has made out case for grant of anticipatory bail with conditions. 7. In the result, the following ORDER i) The petition is allowed. - 5 - HC-KAR NC: 2025:KHC:49919 CRL.P No. 14745 of 2025 ii) The petitioner is ordered to be released on bail in the event of his arrest in Crime No.51/2025 of Rajajinagar Police Station registered for offences punishable under Sections 69, 351(2), 3(5) of BNS and Sections 66(C), 66(E) and 67(A) of Information Technology Act, 2000 subject to following conditions: a) The petitioner –accused No.1 shall voluntarily appear before the Investigating Officer within 15 days from this day and execute bail bond for a sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the Investigating Officer. b) The petitioner –accused No.1 shall cooperate with the police in the investigation and appear before the Investigating Officer whenever called for. - 6 - HC-KAR NC: 2025:KHC:49919 CRL.P No. 14745 of 2025 c) The petitioner –accused No.1 shall not threaten the complainant and other prosecution witnesses. d) The petitioner –accused No.1 shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.
