The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita has been filed to quash the entire proceedings of Complaint Case No. 2982 of 2024, as well as cognizance/ summoning order dated 10.01.2025 by which the learned Magistrate took cognizance under Sections 376, 323, 504, 506 of I.P.C. against the applicant no. 1, under Section 323, 504, 506 of I.P.C. against applicant nos. 2 to 5, Police Station- Govind Nagar, District Kanpur Nagar, pending in the court of Judicial Magistrate, Court No. 4, Kanpur Nagar. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ bail application/ anticipatory bail application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
