This Miscellaneous Petition has been filed seeking to condone the delay of 45 days in filing the Tax Case. 2. The reasons set out in the accompanying affidavit is that the delay was caused on account of hospitalisation and subsequent recovery. 3. Learned counsel for the petitioner would submit that hospitalisation was on account of severe diabetes and attendant complications. 4. Mr.V.Prashanth Kiran, learned Government Advocate, who accepts notice for the respondent, fairly, does not seriously object to the condonation of delay. 5. Hence, and also for the reasons aforesaid, the delay of 45 days in filing the Tax Case is condoned and this Miscellaneous Petition is ordered. 6. Registry is directed to number the Tax Case, if it is otherwise in order, and list the same for admission.
