In pursuance of the earlier order of this Court, Shri Chandan Sharma, learned consel has obtained instructions, which are taken on record. On the strength of the instructions, he submits that 06.09.2025 is the date fixed for auction of the property in question. In view of the above, no useful purpose will be served in keeping the matter pending. Considering the facts and circumstances of the case, without entering into the merits of the case, this petition is disposed of with a direction to the Commercial Court No. 1, Gautam Buddha Nagar to decide the Execution Case No. 1/2024 and Misc. Application No. 21(G) dated 06.03.2025, in accordance with law, expeditiously, preferably, within a period of six months from the date of presentation of a certified copy of this order, if there is no legal impediment. It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
