1. By way of present revision petition, challenge has been laid to an order dated 25.01.2024 passed by the Court of ld. Additional District Judge, Amritsar, whereby an appeal came to be dismissed for want of affixation of requisite court fee, which was preferred at the instance of petitioner, assailing the judgment and decree dated 06.11.2023 passed by the Court of ld. Civil Judge (Junior Division), Amritsar, vide which, a suit for possession by way of specific performance was decreed. 2. Though, a perusal of the order shows that the petitioner was repeatedly seeking time for affixation of the Court Fee without justified SONIKA 2025.09.25 09:33 I attest to the accuracy and authenticity of this document
CR-4270-2024 (O&M) --2-- reasons, however, purely, in the interest of justice and in order to ensure the adjudication of the rights of the parties to the appeal, on merits, the petitioner is afforded one last opportunity to affix the requisite Court Fee as per law, in Civil Appeal No.345 of 2023, titled as “Manoj Kumar vs. Kanwar Bir Singh etc.” . 3. In view of the above, the present petition is allowed and the impugned order dated 25.01.2024 is set aside, civil appeal No.345 of 2023 is ordered to be restored at its original number and the parties are directed to appear before the Court concerned i.e. the ld. Additional District Judge, Amritsar on 29.09.2025. It is made clear that in case, the petitioner fails to deposit the requisite Court fee within 10 days of their appearance before the Court concerned, the appeal shall be deemed to be dismissed with no further orders required in this regard. 3.1 Further, learned counsel for the petitioner informs that the cost of Rs.25,000/- towards litigation expenses stands deposited by him before the Registry of this Court. 3.2 As such, the Registry of this Court is requested to transmit the aforesaid cost of Rs.25,000/- to the respondent through learned counsel representing him in the present revision petition. 4. Pending applications, if any, also stand disposed of.
