GOLLAPALLI MAHESWARA RAO counsel for the Respondent/complainant: 1.PUBLIC PROSECUTOR The Court made the following Order: This Criminal Petition under Sections 480 and 483 of the BNSS, has been filed by the petitioner herein/A1, seeking regular bail in Cr-lme No.196 of 2024 of Anandapuram Police Station, registered for the offence punishable under Section 20(b)(ii)(C) read with 8(c) of the NDPS AIffA. 2. Case of the prosecution, in br'lef, iS that On 30.08.2024, on receipt of credible information, the Sub-Inspector of Police along with his staff and med-lators rushed to podugupalem Village, and caught the accused in possession of 340 Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report. 3. Heard. Perused the material On record. 4. Learned counsel for the Petitioner COntended that the Petitioner was arrested on 31.08.2024 and since then he has been in judicial +.-- EiE= i / EE-fi custody and that statutory' period of 180 days is completed and police have not filed charge sheet and requests to enlarge the petitioner on bail. 5. On the other hand, learned Assistant Public Prosecutor also confirms non-filing of charge sheet by the polI'Ce even after Statutory period is completed, but opposed to grant bail. 6. As seen from the record, the petitioner was remanded to judicial custody on 31.08.2024 and charge sheet has not been filed. Most of the witnesses are shown to be official witnesses and the release of the accused would not cause hampering of investigation. The petitioner had Permanent abode and there is no possibility of his fleeing away from justice. lt is subml'tted by the learned Assistant Public Prosecutor that no application is filed seeking extension of time for conducting further investigation as contemplated under Section 36A (4) of the NDPS Act. 7. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petI®tiOner herein With the following conditions: i. The petitioner herein/Al shall be released on bail on his executing a personal bond for Rs.1,00,000/-(Rupees one lakh only) each with two (02) sureties for a like sum each to the satisfaction of the learned I Additional District and Sessions Judge-Gum-Special Judge for Trail of,Offences under NDPS Act, Visakhapatnam. =E= .,.. ii. on release, the petitioner shall appear before the Station House officer concerned, once in a fortnight i.e., on lst and 15th of every month between lO.00 AM and 01.00 PM., for a Period Of four (4) months. i'li. The pet-ltioner is directed not tO hamper the investigation and tamper with the prosecution witnesses. 8. Accordingly, the Criminal petition is allowed.
