ORDER The civil revision petition has been filed to set aside the judgment and decree made in LAOP No.53 of 2015 dated 21.08.2017 on the file of the VI Assistant City Civil Court, Chennai. 2.Heard the learned counsel appearing for the petitioner as well as Mr.A.Babu, learned Special Government Pleader appearing for the respondent.
3. The subject matter of acquisition was land in survey No.344/15 1/4 https://www.mhc.tn.gov.in/judis
CRP.NPD.No.2690 of 2025 measuring an extent of 5 cents, Velacherry village, Mambalam Guindy Taluk, Chennai. The land was sought to be acquired for the purpose of formation of Southern Sector Inner Ring Road, between Velacherry Phase II and St.Thomas Mount and the LAOP Court has fixed compensation of Rs.2,000/- per sq.ft which is payable along with 30% solatium and 12% Additional market value and the claimant is entered for 9% interest on the aggregated compensation amount for one year from the date of award viz., 31.08.2010 and thereafter, 9% interest till the entire compensation amount is deposited. 4.The learned counsel appearing for the parties brings to my notice that in a batch of revision petitions in CRP.Nos.1413 of 2020 etc., touching the very same acquisition was the subject matter of challenge. This Court by
order dated 01.10.2020 fixed the compensation at Rs.1655/- per sq.ft. The said common order of this Court was challenged in SLP (Civil) No.13953 to 14043 of 2022 and the Hon'ble Supreme Court by order dated 30.07.2024 dismissed the special leave petitions, confirming the award at Rs.1655 per sq.ft. Considering that the very same scheme has already been subject matter of earlier land acquisition proceedings and finally, the compensation has been fixed at Rs.1655/- per sq.ft., I am inclined to dispose of the present 2/4 https://www.mhc.tn.gov.in/judis
CRP.NPD.No.2690 of 2025 civil revision petition fixing the compensation at Rs.1655/- per sq.ft., which shall be payable together 30% solatium and 12% Additional market value and 9% interest on the aggregated compensation amount for one year from the date of award viz., 31.08.2010 and thereafter, 9% interest till the entire compensation amount is deposited. 5.Accordingly, the civil revision petition is partly allowed. No costs. Consequently, connected miscellaneous petition is closed.
