Issue a writ, order or direction in the nature of mandamus directing and commanding the Nayab Tehsildar Pawai, Tehsil Phoolpur District Azamgarh (Respondent No.2) to decide the Mutation Case No. 1310 of 2022 Computer Case No (T202215060303293) (Vijay Kumar Singh Versus Bhairav Son of Kali Charan) filed under Section 35 of U.P. Revenue Code 2006, pending before the Nayab Tehsildar Pawai, Tehsil Phoolpur District Azamgarh, within stipulated period." 2. It is contended by learned counsel for the petitioner that mutation proceedings under Section 35 of U.P. Revenue Code, 2006 are pending consideration before respondent no. 2 since 2022. The sole prayer made in the writ petition is for expeditious disposal of the same. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon respondent no. 2 to decide the Mutation Case No. 1310 of 2022 Computer Case No. T202215060303293, Vijay Kumar Singh vs. Bhairav Son of Kali Charan, in accordance with law, after hearing all affected parties, preferably within a period of three months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
