1. Heard Sri. Venkatesh C, learned counsel for the petitioner and Sri. Abhinav Ramanand, learned counsel for the respondents.
2. First defendant in OS No.575/2017 is the revision petitioner challenging the validity of the rejection

Facts in the nutshell which are utmost necessary for the disposal of the present revision petition are as under :
3.1 Plaintiff being the Partnership Firm represented by its' partners, filed a suit for recovery of money in O.S. No.575/2017 based on a market rate. 3.2 Defendant pursuant to the suit summons, entered appearance, filed written statement denying the plaint averments also raising the defence that the suit is barred by limitation. 3.3 Learned Trial Judge after considering the rival pleadings, raised necessary issues including the issue with regard to the limitation aspect as Issue No.4. - 5 -

3.4 In the meantime, first defendant filed an application under Order VII Rule 11 of the Code of Civil Procedure contending that suit is per se barred by limitation and therefore plaint is to be rejected. 3.5 Same was opposed by the plaintiff by filing detailed objections. 3.6 Learned trial judge having heard the arguments of the parties dismissed the said application. 4. Being aggrieved by the same, petitioner is before this Court in this revision. 5. Sri. C. Venkatesh, learned counsel for the petitioner reiterating the grounds urged in the revision petition vehemently contented that per se the suit is barred by time and an issue is framed, and when the material on record including the plaint averments would be sufficient enough to reject the suit on the question of

HC-KAR NC: 2025:KHC:46790 CRP No. 39 of 2023 limitation, directing the parties to face the trial has resulted in not only abuse of Court but also miscarriage of justice and sought for allowing the revision petition. 6. Per contra, Sri. Abhinav Ramanand, learned counsel for the plaintiff/respondents supports the impugned order. 7. Having heard the argument of both sides, this Court perused the material on record meticulously. 8. On such perusal of the material on record, it is crystal clear that the suit is based on mortgage of the property by way of deposit of title deeds. In which case, the law of limitation is not three years as is contented by the counsel for the revision petitioner. 9. Anyway whether the suit is in time or not is a question that has been raised as an issue by the Trial Court based on the rival pleadings.
The parties are required to face the trial and place necessary material

When there is a triable issue, the question of limitation especially with regard to the attendant facts and circumstances of the case cannot be treated as a ground to reject the plaint at the threshold. 11. Hence, following order:
ORDER
