THIS WRIT PETITION IS LISTED FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, AN ORDER IS MADE AS UNDER: ORAL ORDER Sri.H.N.Shashidhara., Senior counsel on behalf of Sri.Suhas.H.S., for the petitioner and Sri.H.V.Devaraju., counsel for respondents 1 to 3 have appeared in person. 2. The communication dated 27.02.2019 issued by the second respondent vide Annexure-A is called into question in this Writ Petition on several grounds as setout in the Memorandum of Writ Petition. 3. Counsel for the respective parties urged several contentions. Heard the arguments and perused the Writ papers with care. 4. Suffice it to note that a communication was issued by the second respondent to the petitioner demanding back- billing charges in a sum of Rs.21,38,429/-. The petitioner replied for the same and requested the authority to furnish - 3 - HC-KAR NC: 2025:KHC:27895 WP No. 21427 of 2024 documents to enable him to put-forth his objections. The grievance of the petitioner is that his request has not been accorded as of today. Sri.H.N.Shashidhara., Senior counsel in presenting his arguments submits that if an opportunity of personal hearing is accorded to the petitioner, he will appear before the authority and put-forth his contentions. He argued by saying that a direction may be issued to the authorities to furnish necessary documents to the petitioner to put-forth his contentions. Senior counsel, therefore, submits that an appropriate order may be passed. Counsel Sri.H.V.Devaraju., submits that an appropriate order may be passed. The oral submission made by the counsel for the respective parties is placed on record. 5. It is not in dispute that the petitioner had replied to the communication. However, his grievance is about non- furnishing of the necessary documents. In my view, if a personal hearing is accorded, the petitioner's grievance may be - 4 - HC-KAR NC: 2025:KHC:27895 WP No. 21427 of 2024 addressed in the right perspective. Hence, this Court deems it proper to direct the petitioner to appear before the Assistant Executive Engineer on 18.08.2025 at 3.00 pm., without awaiting any notice. The petitioner may request for furnishing of the documents by making a list. If the list is furnished by the petitioner, the Assistant Executive Engineer is directed to furnish the documents. Needless to say, principles of natural justice must be adhered to and the proceedings must conclude as per Clause 42.06 of the Conditions of Supply of Electricity of Distribution Licensees in the State of Karnataka.
