Coram : Hon’ble Mr. Justice N.S.Shekhawat Present : Mr. Arshdeep Singh Brar, Advocate, for the petitioner. Mr. I.P.S. Sabharwal, DAG, Punjab. *** N.S.Shekhawat J. (Oral)
1. The petitioner has filed the present petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 with a prayer to grant anticipatory bail to him in case FIR No.48 dated 24.05.2025, registered under Sections 15 and 29 of the NDPS Act, at Police Station Mehna, District Moga.
2. After hearing learned counsel for the parties on 30.06.2025, this Court had noted the following contentions raised by learned counsel for the petitioner:-
“It is, inter alia, contended by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in this case. He contends that the petitioner is not even named in the FIR but was nominated on the basis of alleged disclosure statement of the co-accused Jaswinder Singh, who in turn was nominated by Jasvir Singh and Jaspal Singh, from whom recovery of 50kg of poppy husk was allegedly recovered. He contends that the petitioner has no concern with the aforesaid co-accused nor the petitioner is having any criminal antecedents. Hence, the instant petition.”
3.
Learned counsel for the petitioner has reiterated the submissions and submitted that the petitioner is the first offender and was never involved in any other criminal activity. HEMLATA 2025.07.15 23:13 I attest to the accuracy and integrity of this document

4. On the other hand, status report by way of an affidavit of Deputy Superintendent of Police, Dharamkot, District Moga has been filed by learned State counsel in Court today and the same is taken on record. Learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner on the ground that serious allegations have been levelled against the present petitioner. However, he admits that the petitioner is not involved in any other case.
5. I have heard learned counsel for the parties and perused the record.
6. In the present case, 50 kg of poppy husk was recovered from Jasvir Singh and Jaspal Singh, co-accused. During the course of investigation, both the accused had named Jaswinder Singh, co-accused, who further named the petitioner in his statement. The admissibility of such statements is yet to be decided by the trial Court and the custodial interrogation of the petitioner may not be required at this stage. Further, the petitioner is the first offender and was never involved in any other criminal case.
7. Without commenting any further on the merits of the case, the present petition is allowed. The petitioner is granted concession of anticipatory bail, subject to the conditions as provided under Section 482(2) of the BNSS. It will be open for the Investigating Officer to call the petitioner to join investigation, if so required, by issuing a written notice in this regard and he shall abide by the conditions mentioned in Section 482(2) of the BNSS.
