THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY jE/ CRIMINAL PETITION No.1512 of 2025 ORDER : The Criminal Petition, u/See.482 of the Bharatiya Nagarik suraksha sanhita, 2023, 'ls filed on behalf of the petitioner/A3 to grant anticipatory bail in connection with Crime No.31/2024 of Pod'lli Police Station, Prakasam District. 2) A case has been registered against the Petitioner and Others initially for the offence punishable u/See.304A IPC and later Section of law was altered adding sections 120B, 302, 201 read with 34 lPC. 3) Case of the prosecution 'In brief iS that On 04.02.2024 at about 9.00 pm at milk center near Katurivaripalem village in between Agraharam village to Katurivaripalem road wherein the informant, along With his son and the deceased, was going to Ongole for hospital in their Swift Dzire car bearing registration no.AP 39 CB 0524. While en-route on the same day, they reached Katurivaripalem outskirts at near milk center the car steering was not controlled and as a result hit a tree on the left side of the road and the son and daughter of the informant became unconscious and the son of the informant called 108 ambulance and was taken tO hospital, podili, there the doctors declared that the daughter of the informant was already d,Cad. Then the compla-lnant gave report tO POliCe. During the course of investigat'lon, the investigating offllcer got conducted autopsy over the dead body of the deceased where the Doctor opined that the _~-3ctrf3* pr : c3-.------it ` - death of the deceased.I-s a homl'cI'de and she was murdered. Basing on ~ the same, the Section of law was altered. 4) Heard. Perused the record. 5) Learned Assistant Public Prosecutor submitted that the investigation is at cruel-al Stage and some more wI-tneSSeS are to be examined and prays to dismiss the anticipatory bail application. 6) On a perusal of the material aval'lable on record goes to show that the petitioner has been arrayed as accused basing on the confessI-Onal statement of A1. Even as per the confessional statement, I-I has been alleged that the accused shared the facts wI-th A3 and later both the accused contacted wI-th the Petitioner herein who assisted the medical officer in conducting postmortem examination on the date of the death of the deceased and preserved viscera as per the directl®ons of the medical officer. Learned counsel for the petitioner submits that the death of the deceased was due to asphyxl-a assocI-ated With multiple pressure injuries Present over the neck. Except the confessional statement of co-accused, there Its nO Other material to connect the accused with the crime. Apart from that the alleged incident is said to have taken place on o4.02,2024 whereas the petitioner has been arrayed as accused after lapse of one week. In vl'ew of the facts and circumstances of the case, this court is inclined to grant the prayer of antjcipatory bail to the petI'tiOner. 7) AccordI'ngly, in the event Of the arrest of the petitioner/A3 with regard to thl-s crime, he shall be released on bail on his executing a ~=- I --_-_e To, Personal bond for a Sum Of Rs.10,000/-(Rupees ten thousand only) wl'th I. two sureties for the like sum each to the satisfaction of the arresting police officials and also on condition that he shall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the prosecution witnesses. The petI'tiOner Shall attend before the Stall-On House Officer concerned once in a week i.e. on every sunday between 10.00 am and 5.00 pm till filing of charge sheet. 8) Accordingly, the Criminal Petition is allowed. sd/-A.
