Neutral Citation No. - 2025:AHC:108397-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 1697 of 2025 Petitioner :- Beerendra Kumar Kanaujia Respondent :- State of U.P. and 6 others Counsel for Petitioner :- Amit Kumar Tiwari, Brahma Nand Pandey Counsel for Respondent :- Meenakshi Singh, A.C.S.C., Dharmaveer Singh Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J. 1. This petition purportedly in public interest has been filed by the petitioner seeking a direction to the respondents to remove the encroachments made by respondent no. 7 upon the 6 feet land from Arazi No. 449 Minjumla, situated at Village Sahadatpura, Pargana - Mau, Tehsil - Maunath Bhanjan, District - Mau. 2. A perusal of the record indicates that between the petitioner and respondent no. 7 there is a private dispute pertaining to the user of the land in question, which is recorded as Minjumla and various complaints with regard to the user have been made by the petitioner. The petitioner has relied on a private sale deed for the purpose of claiming the land in question as belonging to Rasta, which plea on its own strength, cannot be countenanced. 3. Further looking to the nature of dispute sought to be raised, it cannot be said that any public interest is involved and the petition is, therefore, dismissed leaving it open for the petitioner to take appropriate proceedings in accordance with law.
