Issue a writ order or direction in the nature of mandamus directing the District Magistrate Prayagraj/Allahabad to decide the representation of the petitioner dated 30-06-2025 within stipulated period which may be fixed by this Hon'ble Court. ii. issue a writ order or direction in the nature of mandamus directing the respondent No. 2 and 3 (District Magistrate Prayagraj/Allahabad) and Sub- Divisional Magistrate Tehsil Soraon District Prayagraj/Allahabad to restrain the respondent no. 5 (Pradhan) of the Gaonsabha Bhagautipur Khutahna Pargana and Tehsil Soraon District Prayagraj/Allahabad not to made illegal construction on the Gata no. 498M situated at Village Bhagautipur Khutahna Pargana and Tehsil Soraon District Prayagraj/Allahabad and maintained status quo." It is contended that ventilating his grievance petitioner has already approached the District Magistrate, Prayagraj as well as Sub Divisional Magistrate, Soraon, Prayagra/Allahabad, and an application has already been moved which is pending consideration. Learned counsel submits that the said application/representation may be decided expeditiously. As no useful purpose would be served in keeping the matter pending or issuing notice to the private respondents, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a direction upon respondent no.2- District Magistrate, Prayagraj to decide the representation dated 30.06.2025, in accordance with law, after hearing all affected parties, preferably within a period of one month from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
