Learned advocate appearing for the petitioner submits that the petitioner is in custody for one month and seven months and there is no progress in the trial of the case, as such, on any stringent condition the petitioner may be released on bail. 2. Learned advocate appearing for the State opposes the prayer for bail and submits that 10000 bottles of phensedyl were recovered from the vehicle and the petitioner was consciously aware and present at the spot. As such, his Page 2 complicity in the offence is proved beyond reasonable doubt. Prosecution is exerting efforts for progressing with the case but for reasons beyond control is unable to proceed. 3. Having considered the fact that commercial quantity of contraband has been seized in this case, I am of the opinion that the rigors of Section 37 of the Narcotics Drugs and Psychotropic Substances Act, 1985 is attracted. 4. Consequently, the prayer for bail is rejected at this stage. 5. Accordingly, CRM(NDPS) 917 of 2025 is dismissed. 6. All parties shall act on the basis of server copy of this order duly downloaded from the official website of this Court. 7. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities. ( Tirthankar Ghosh, J. )
