Neutral Citation No. - 2025:AHC:108266-DB Court No. - 40 Case :- WRIT - C No. - 21561 of 2025 Petitioner :- Ravindra Kumar Mishra Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Sudarshan Singh Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Jayant Banerji,J. Petitioner claims to have performed certain work of construction/strengthening of road pursuant to award of contract by the third respondent. It is asserted that part of the admitted sum has been released but despite expiry of sufficient period a sum of Rs.7 lakhs still remains pending. Grievance is that withholding of admitted dues by the concerned respondent despite expiry of sufficient period in the facts and circumstances is arbitrary. Learned Standing counsel states that grievance of the petitioner would be got examined by the third respondent. Considering the nature of order proposed to be passed we are not inclined to issue notices to respondent nos.3 to 6. In the facts of the case, we permit the petitioner to represent his grievance before respondent no.4, who shall get the facts verified and would pass appropriate orders in respect of petitioner's claim for release of admitted dues within a period of two months. It is made clear that we have not adjudicated the petitioner's entitlement and all issues are left open for examination by the authority concerned, at the first instance.
