The case of the petitioner is that she underwent a sterilization operation on 14.03.2023 at Community Health Centre, Holagarh, Prayagraj. A certificate evidencing the said fact was issued on 14.03.2023 by Superintendent, Community Health Centre, Holagarh, Sangipur, Prayagraj. However, the said operation has failed and on account of which she became pregnant and also delivered a child. The petitioner made application on 18.06.2025 for compensation. As no compensation has been paid to her so far, the present writ petition has been filed praying for direction to respondents no. 2 and 3 to decide her claim, as contained in her representation dated 18.06.2025. 2. Learned Standing Counsel has placed on record the instructions received from Chief Medical Officer, Prayagraj and according to which he by a communication dated 22.08.2025 has sought report from Superintendent, Community Health Centre, Holagarh, Prayagraj. A copy of the said communication has been annexed along with the instructions. 3. It is evident from the instructions furnished by Chief Medical Officer, Prayagraj that he is examining the claim of the petitioner. 4. Consequently, we dispose of the writ petition with direction to respondent no. 3 to examine the claim and make appropriate Versus Counsel for Petitioner(s) : Subhash Chandra Counsel for Respondent(s) : C.S.C. Suman .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) recommendation, as per the scheme, to the Competent Authority, so that decision is taken on the claim of the petitioner, expeditiously.
