Pandey, along with Mr. Goutam Khetrapal, learned counsel for the petitioner. Also heard Mr. Malay Kumar Jain, learned Panel Lawyer, 2 appearing for the Respondent/State. 2. The present petition has been filed by the petitioner with the following prayer: "i. Set-aside/quash the impugned FIR No. 12/2025 registered at Police Station, Gobra Nawapara, District Raipur (C.G.) against the petitioners for the offence punishable under Section 420, 34 of IPC. ii. Grant any other relief, which may be deemed fit in given facts and circumstances of the case, in favour of petitioners." 3. At the time of hearing, this Court has observed that the petitioner has filed the present petition without appropriate pleading and appears to be no such averments made in the present petition that the petitioner is ready to return the amount and to cancel the subject agreement which has been argued by the learned counsel for the petitioner. Moreover the prayer which has been made in the present petition is also defective one as there is no mention of the date on which the FIR has been registered to which learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with a liberty to file afresh petition with proper prayer. 4. Learned State counsel has no objection. 5. In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for subject to depositing a sum of Rs. 2,000/- as cost by the petitioner in the Registry of this Court within a period of one week from today and the said amount shall be transmitted to the Government Home for Mentally Underdeveloped Children Mana Camp, District Raipur (C.G.).
