Neutral Citation No. - 2025:AHC:108115 Court No. - 4 Case :- WRIT - A No. - 9050 of 2025 Petitioner :- Anil Kumar Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Shahnawaz Akhtar Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J.
1. Heard learned counsel for the parties.
2. By means of this petition filed under Article 226 of Constitution of India, the petitioner has prayed for quashing of the transfer
order dated 14.06.2025 on twin grounds, one that his wife is ailing and undergoing treatment of spinal cord; and his children are admitted in school and it will be too difficult for him to manage things if he is transferred to Bareilly. Second ground is that currently three Senior Assistants are working in the office of Public Works Department at Budaun and if petitioner is transferred the work of the office would suffer as has been accepted by Executive Engineer, Prantiya Khand, Public Works Department, Budaun in his letter dated 18.06.2025.
3. Learned Standing Counsel submits that since the petitioner has stayed for more than three years at Budaun he is eligible for posting as per transfer policy but he is not averse to the petitioner's representation being decided in accordance with law provided the petitioner makes a fresh representation within a stipulate period of time.
4. In view of the above, this petition stands disposed of with direction to the petitioner to make representation regarding his claim annexing a copy of the recommendation made by the Executive Engineer concerned on 18.06.2025 within a period of two weeks from the date of production of certified copy of this
order before the competent authority which shall be looked into and considered and shall also be decided as expeditiously as possible preferably within a further period of four weeks.
5. Needless to add order to be passed shall be reasoned and speaking one.
