JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioners are seeking to enlarge them on anticipatory bail in Crime No. 94/2025 registered at Tumkur Rural Police Station, Tumkur, for the offence punishable under Section 115(2), 352, 329(4), 351(2), 109 and 3(5) of BNS, 2023. 2. Complaint is lodged by one Tholasamma, wife of Late Siddaiah. It is alleged that on 21.04.2025 at about - 3 - HC-KAR NC: 2025:KHC:35692 CRL.P No. 11077 of 2025 07.00 p.m., accused Nos.1 to 4 named in the FIR trespassed into her house holding dangerous weapons, abused her son Mahesh in filthy language and accused No.1 - Girish assaulted him on his right shoulder with an iron rod and accused No.2 - Sunil assaulted with a rod on his shoulder and legs, with an intention to commit his murder. Other accused are alleged to have assaulted him with hands. 3. Wound certificate made available by the learned HCGP indicate that, injured Mahesh has suffered dislocation of right shoulder. The said injury is stated to be grievous in nature. Learned HCGP contended, the victim's mother - first informant and one Ramanjaneya are the eye-witnesses. 4. As per prosecution, accused trespassed into the house of the victim and assaulted him with an iron rod. Victim has suffered fracture. In the facts and circumstances, this is not a case for anticipatory bail. Moreover, petitioner along with accused No.2 had - 4 - HC-KAR NC: 2025:KHC:35692 CRL.P No. 11077 of 2025 approached this Court in Crl.P.No.7134/2025 seeking similar prayer. The said petition was dismissed as not pressed with liberty to the petitioners to surrender before the jurisdictional Sessions Court and file necessary application seeking regular bail.
