The petitioner is the proprietor of M/s.River Salon and Day Spa offering a wide array of therapeutic massages, physiotherapy based treatments and beauty care services. In order to obtain no objection certificate to get license, the petitioner submitted application before the second respondent. However, the said request was rejected on the ground that two of the employees of the petitioner’s spa center did not posses valid completion course certificate to do massage and spa therapy. The certificates produced by the petitioner are not recognized by the State of Central governments. Page 2 of 6 https://www.mhc.tn.gov.in/judis W.P.No.1022 of 2025 3. The learned counsel appearing for the petitioner submits that in We Academy Group in which the petitioner’s employees completed their course in Anatomy Physiology and Spa Therapy and it is affiliated with the Indian Council of Professional Education Mission. Hence, he prayed to allow this Writ Petition. 4. Heard the learned counsel appearing on either side and perused the materials placed before this Court. 5. It is seen from the records that, the petitioner failed to produce any document to show that the We Academy Group has recognized by any one of the State or Central government. The affiliation is completely different from getting approval and recognition and as such, the second respondent rightly rejected the request made by the petitioner seeking no objection certificate. However, the petitioner can apply afresh with qualified employees as required under law for no objection certificate to the second respondent. On receipt of such request, the second respondent is directed to verify the same and if the petitioner complied the required conditions, issue the no objection certificate, in accordance with law.
