THIS CMP IS FILED UNDER SECTION 11(5) AND 11(6) OF THE ARBITRATION AND CONCILIATION ACT, 1996 PRAYING TO APPOINT A SOLE ARBITRATOR TO ADJUDICATE THE DISPUTES AND DIFFERENCE BETWEEN THE PETITIONER AND THE RESPONDENT ARISING OUT OF THE AGREEMENT DATED 15.05.2024 (ANNEXURE-A AND THE ADDENDUM DATED 19.06.2024, WHICH CONTAIN CLAUSE 20 - THE ARBITRATION CLAUSE, PROVIDING FOR RESOLUTION OF DISPUTES BY ARBITRATION WITH THE SEAT AND VENUE AT BENGALURU.

ORAL ORDER
1. Petitioner is before this Court seeking for the following reliefs:
"a) Appoint a Sole Arbitrator to adjudicate the disputes and differences between the Petitioner and the Respondent arising out of the Agreement dated 15.05.2024 (Annexure A) and the Addendum dated 19.06.2024, which contain clause 20 - the Arbitration Clause, providing for resolution of disputes by arbitration with the seat and venue at Bengaluru. b) Pass such other or further order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."

2. Learned counsel appearing for the Petitioner has filed a memo dated 19.12.2025, seeking permission of this Court to withdraw the petition. The said memo reads as follows:
"The Petitioner most respectfully submits as follows: The Petitioner and the Respondent are presently trying to amicably setting the disputes and thus the Petitioner wishes to withdraw the present petition and humbly seeks permission of this Hon'ble Court to withdraw the petition, reserving the liberty to refile a fresh petition, in the event the settlement talks between the parties fail."
3. Accepting the said memo and submission of the
learned counsel for the Petitioner, the petition stands dismissed as withdrawn.
4. Liberty is reserved to the Petitioner to approach this Court if a settlement is not arrived at.
